CCM Constitution

ARTICLE 1: ESTABLISHMENT
a) There is hereby established a political party to be known as CHAMA CHA MWANANCHI (herein after referred to as “ The party” or “CCM”) and to be registered as a political party under societies Act (Chapter 108 of the Laws of Kenya) or any other Act amending or replacing the same.

b) The party is founded on the democratic principles of good governance, Unity, Justice, Freedom, honesty and Equality. Chama Cha Mwananchi – CCM is a socialist party, none religious, sect or cult.

c) The leadership of the party shall be based on the equality of all persons and shall be based on the highest personal integrity. All leaders of the party shall strive to live within the tenets of the members and leadership code.

ARTICLE 2: AIMS AND OBJECTIVES

a) To establish a democratic and constitutional government of Kenya within the frame work of a pluralistic democracy and good governance, which is founded on the principles of good governance, Unity, Justice, Liberty and Equality and which is transparent and accountable to the electorate.

b) To pursue, protect and promote civil, political, economic, religious, social or cultural rights and freedoms of the individual inter alia, the right of life and human dignity, trial and equality before the law; the freedom of movement and association, thought, conscience, expression, religion, the right to participate in public affairs, the right to work and enjoy favorable working conditions.

c) To pursue and promote the rule of law and the separation of the powers between the three arms of Government, namely; the Legislature, Executive and Judiciary.

d) To work and ensure the repeal and / amendment of all unjust and oppressive laws and promote law reform in accordance with the principles of natural justice.

e) To work towards the independence of the civil service by de-linking the same from any political party.

f) To ensure the presidential term of office shall be limited to a maximum period of only five years terms.

g) To pursue the provision and improvement of health, education and welfare services so as to raise the standard and quality life of the people of Kenya.

h) To encourage and promote a strong cooperative movement managed and controlled by the members.

i) To enhance the cultural life of Kenyans in all spheres of National Development.

j) To promote the protection of all rightfully owned public land, utilities, natural resources, i.e. the improvement, management and conservation of the environment and responsible utilization of all land, national wealth and resources for the betterment of the lives of all Kenyans and the future generations.

k) To formulate and oversee sound national population policies in order to improve the quality of all Kenyans.

l) To educate and create awareness among Kenyans of all public matters, issues and policies with a view to enhancing and maintaining a just, open and democratic system or society.

m) To support regional and international organizations or groupings aimed at achieving rapid social and economic development and innovation.

n) To advocate and promote respect for the 1979 United Nation Conventions for the Elimination of all form of Discrimination Against Women i.e. to guard against all forms of discrimination against women and men and to ensure that such practices are punishable by the law.

o) To pursue, promote and protect the rights of workers in their demands for just salaries, commensurate with their labor contribution and in line with the costs of living. To promote the welfare of the disabled people.

p) To strive for the re-establishment of the right of workers to negotiate freely with the employers, and the right to make industrial actions where necessary.

q) To promote African Unity, regional and sub-regional co-operation and integration. To work with regional political Parties and pressure groups that support the advancement of the East African people and the creation of an East African Government.

r) To advocate, promote and comply with the United Nations International Bill of Human Right, the African Charter of Human and People’s right and the Convention against Torture and other Cruel, inhuman or Degrading Treatment and any other internationally and locally recognized democratic conventions.

s) To nominate party candidates in respect of the Presidential, Parliamentary, and Civic elections in Kenya and the region.

t) To ensure the strengthening of Parliament, Parliamentary Committees and Civic Authorities for the effective operation of a representative.

u) To promote and establish a fair and just leadership in the governance of the country, devoid of corruption, nepotism, tribalism and all forms of discrimination.

v) To establish Branches, Location/ward and sub-location/ward committee in all parts of Kenya, and

w) To establish women congress and Congresses of Young Democrats from Sub-location/wards through Locations Branches to National Levels.

ARTICLE 3: MEMBERSHIP
a) Any citizen of Kenya who is eighteen years old and above and who accepts and adheres to the objectives, programmes, directives, code of conduct of members and discipline of the party shall be eligible to be a member of Chama Cha Mwananchi provided the he/she is not a member of any other Political party.

b) Those eligible and desiring membership of the party may apply either verbally or in writing to any authorized official or agent of the party for enrolment. On application each member shall be issued with a members rules, code of conduct, obligations and regulations form to append his or her signature as a rule and thereafter given a membership card.

c) Each member of the party shall on enrolment pay an admission fee of Kshs10/= or as otherwise determined by the party from time to time.; and

d) Each member of the party shall pay his/her Branch or headquarters an annual

e) subscription of Kshs10/= or as otherwise determined by the party.

ARTICLE 4: TERMINATION OF MEMBERSHIP
a) A member shall cease to be a member if:-

i) He or she submits to the secretary of the sub-branch in which he or she is registered a letter of resignation signed by him/her/or if one joins similar political parties, movements, organizations or groupings competing with CCM for political office/ or joins CCM opposition. A member shall lose membership if one fails to observe the internal rules, obligations and regulations of the party at any one time. If a member subscribes to a different ideology apart from the CCM democratic socialist ideology.

ii) Accepts an office or promotes the activities of any other political party without the permission of the NATIONAL EXECUTIVE COMMITTEE (NEC)

iii) Any member shall be expelled from membership of CCM if the committee so recommends and if a general or a special meeting of the party shall resolve by two-thirds majority of the members present that such a member be immediately expelled on the grounds that his/her conduct has adversely affected the reputation or dignity of the party, or one has contravened any of the provisions of the party. The NEC, Branch committees shall have the power to suspend a member from membership until the next general meeting of the Party following such suspension but not withstanding such suspension a member whose expulsions is proposed shall have the right to address the Branch, NEC general meeting at which ones expulsion is to be considered.

b) A member who ceases to be member shall not be entitled to a refund of any subscriptions. A suspended or expelled member shall with immediate effect if a party official vacate office, return to the relevant organ / Branch/ NEC all Party documents, Monies, items, and all stationary or movable assets belonging to CCM.

ARTICLE 5: NATIONAL OFFICIALS/ OFFICE BEARERS

a) The party shall have the following elected National Officials who must observe fully the CODE OF CONDUCT FOR CCM LEADERS

14. Director of Elections and mobilisation

15. Asistant Director of Elections.

16. National Executive Director – co-opted

17. Nine permanent CCM founder Members; Dick Kamau, Hon Koigi Wamwere,

Haron Njenga Kamuga, James Waweru Kimani, Moses Kagwe, James Maigua, Mohammed Guled Farah, Ndungu Wainaina, Bernad Chege Waweru.

b) An exemption is extended to only the first interim NEC officials and the 9 permanent founder members, the interim Branch officials and provincial mobilizers appointed by the interim NEC officials officially to hold office before the first elections are held. Elections must be held soon after a reasonable number of membership of the party is recruited. Thereafter, all National Officials in all other party organs shall be elected at the National Delegates Convention by secret ballot or any other democratic method(s) acceptable to the delegates. Branch officials shall be elected by members of the Branch as stipulated in this constitution. They shall hold office for a period of four (4) years and shall be eligible for re-election at the expiry of their terms of office if not over 70 years of age.

c) At least one half of the National Officials shall be held by women.

d) Any National Official may attend any meeting(s) organized by the Branch Organization Parts as an ex-official member.

e) Founder members shall be Permanent members of the party and not subject to removal as long as they abide by the rules and member’s code of conduct and does not engage in actions deemed and proved to be detrimental to the survival and unity of the party. They are the rightful permanent guardians of the party and shall participate in all party matters and meetings at the National level. They are members of all top party organs and have the right to vote in matters of interest of the party They can if necessary attend Branch meetings of any Party organs if they deem necessary. They can within the authorized Party organs propose the removal from office or the Party membership of any Party official acting contrarily to the Party’s constitution and objectives. They respect the internal Party operational rules, practice justice, honesty and freedom in the party. Together with the chairperson and the NEC they see to it that order and discipline are maintained within all party organs.

ARTICLE 6: DUTIES OF THE OFFICIALS:-

Chairperson

The chairperson shall be the head of the party and he or she shall provide leadership and articulate party policies. The chairperson of Chama Cha Mwananchi in liaison and with approval by NEC may appoint from the party’s Parliamentary Group a team of leaders (shadow cabinet), to be responsible for various issues of public concern at any period(s) when the party is not in the government. Such leaders shall perform the duties of scrutinizing on the policies of the party in power or National and International issues in liaison with Chama Cha Mwananchi NEC Officials. The chairperson, in liaison with the relevant Party organs ensure discipline and order in the party and in accordance with this constitution. For smooth and disciplined working order of the Party the chairperson informs the NEC of his absence from official duties in writing through the Secretary General. other National Party officials opting to be absent for private reason informs the Chairperson and indicates as to when they would resume duty. In the absence of the Chairperson the SG is notified.

The Vice Chairperson

The vice chairperson shall assist the chairperson in all duties pertaining to that office and during an official absence of the chairperson due to party matters, illness, trip outside the country, or loss of membership. The vice chairperson shall assume duty as acting chairperson in the latter’s unexplained absence until NEC recommends otherwise. The vice chairperson must inform the chairperson of his absence from duty in writing and in the absence of the chairman informs the SG.

Secretary General (SG)

The secretary General (SG) shall be responsible for all party’s affairs and staff at the national Secretariat. The organs or bodies which relate to the National Secretariat and the party’ management from the grass-root to the national level. Secretary General shall be the official party spokesperson guided by party policy. The secretary General shall ensure that meetings of the national Executive Committee, the National Governing council and the National Delegates convention takes place as provided for in the constitution and at such other times as may be decided by the national executive Committee. The SG shall keep all legal and official party documents, make or cause to be made all party correspondents and documents, be the official contact with all other local, regional and international Political parties and organizations linked or cooperating with the party at all times and cause to be kept proper records of membership lists, minutes of all meetings of the National Executive Committee, the National Governing Council and the National Delegates Convention and ensure the distribution of such minutes to person or bodies concerned. The SG informs the chairperson or the NEC in the absence of the chairperson of his absence from official duties in writing or by phone. In his absence the asst. SG acts as SG until such time the SG resumes office. Meanwhile the acting asst SG informs and consults with the Chairperson in all activities of the Party in which he participates before action takes place.

Assistant SG

The Assistant SG assist the SG in day to day matters as assigned by the SG. In the absence of the SG, the asst. SG must liaise with the chairperson and the NEC in any matters of National interest. While acting for the SG on behalf of the Party the acting asst SG must inform the chairperson prior to the issue of statements to the media or while giving out any documents committing the Party. Contrary to contacting the chairperson or NEC all such transactions by the Assistant acting SG shall be deemed non official and not binding.

Organizing Secretary (OS)

The organizing Secretary shall supervise the organization of public meetings and functions. The organizing secretary shall supervise the planning and organization of the Governing Council meetings and National Delegates Conventional in liaison with the SG.

The Treasurer

The treasurer shall be in charge of the party’s Financial affairs and responsible for the National Secretariat’s financial transactions of party policy. The treasurer shall prepare or cause the preparation of and submit to the S.G, Chairpeson, National Executive Committee and the national Governing Council, financial statements every quarter of the year, or on a special request by NEC and shall ensure that duly audited Annual statement of Accounts are circulated to the branches and to all the delegates at the same time the notice convening the National Delegates Convention is sent out. The treasurer shall liaise with NEC during his/her work.

The Assist Treasurer (AT)

The Assist Treasurer shall assist the Treasurer in all duties pertaining to that office and shall assume all such duties in the latter’s absence.

Women and Children leader. WCL

The Women and Children leader shall be responsible with all matters concerning women and Children. She shall attend all NEC and all other Top organs of the Party. She will liaise with all Women and Children leaders in the Branches and ensure their interests are taken care of by the Party. WCL will head the National Women and Children Congress Committee of the Party.

Assistant Women and Children leader. AWCL

The Assistant Women and Children leader shall assist the WCL in all matters concerning women and Children. She shall attend all NEC and all other Top organs of the Party. She will liaise with all Women and Children leaders in the Branches and ensure their interests are taken care of by the Party

Youth Affairs and disabled people Secretary. YAD SEC.

The Youth and disabled people Secretary shall be the representative of the group in the party. The YAD shall see to it that the groups’ interests are taken care of by the Party. YAD Secretary shall head the Young Democratic Youth Congress committee of the Party.

Assistant Youth and disabled people Secretary. AYAD SEC

The Assistant Youth and disabled people Secretary shall assist the YAD Sec. in all matters of the this office and be the representative of the group in the party in the absence of the YAD SEC. The AYAD SEC shall see to it that the groups’ interests are taken care of by the Party. In the absence of YAD Secretary the AYAD SEC shall head the Young Democratic Youth Congress committee of the Party.

Legal Secretary. LS

The legal Secretary shall at all times act and see to the legal matters of the Party and as well be the legal advisor to the Party. The LS has the Party authority to appoint any other Legal officer to assist in his absence or to act where the LS requires extra help in running the day to day legal matters of the Party. The legal officer does not vote or address public meetings. The officer can attend any Party organ meeting when necessary or when need arise. Terms of service are based on agreement with NEC.

Director of Elections and mobilisation. DEMO

The official has the duty to plan, manage elections and mobilise the population for recruitment drives. It is his work to educate, inform and sensitize the population on the manifesto of the Party. It is his work to oversee the internal Party elections and those of the National. The official seats in all Top Party organs and has the right to vote on issues raised.

Assistant Director of Elections and mobilisation. DEMO

The official assists the DEMO in all areas as deems the DEMO and acts as DEMO in the absence of DEMO.

National Executive Director -

The official is the senior officer hired to run the Party Secretariat in liaison with the SG. The officer’s duties are defined by the SG office. The director does not vote in any Party organ.

ARTICLE 7: THE MAIN OPERATIONAL ORGANS OF THE PARTY

The main operational part of the Party shall be:-

(a) The national Delegates Convention (NDC)

(b) The National Governing Council (NGC)

(c) The National Executive Committee (NEC)

(d) The Party Election Commission (PEC)

(e) The Board of Trustees (BOT)

(f) The Standing, AD Hoc and specialized Committees(SASC)

(g) The Branch Organization Parts (BOPs)

ARTICLE 8: THE NATIONAL DELEGATES CONVENTION (NDC)

(a) There shall be two classes of National Delegates Conventions; the Annual Delegates Convention and Special Delegates Convention. In both cases the composition of the convention shall be as follows:-

i) All National Officials.

ii) All members of the National Governing Council.

iii) All Party members of the National Assembly.

iv) The main office bearers of the Branch Executive Committee and

v) All Party Councilors who are not Branch Officials

vi) The Chairperson, Secretary, Treasurer and organizing secretary of sub-Branch Committee and the 9 founder members of the Party.

(b) The national Delegates Convention shall be the highest authority of the Party and shall determine the Party’s policies. It shall have the following specific powers, duties and obligations:-

(i) To review, formulate and/ approve all the policies of the Party.

(ii) To examine and approve the audited accounts; to discharge the treasurer from liability, and to set the scale of annual dues to be paid by the Party members.

(iii) To elect from among the eligible members of the Party the National Officials of the Party as listed in Article 6 (a) of this constitution.

(iv) To nominate the Party’s nominee as the Party’s candidate for Presidential Election for the President of the Republic of Kenya

(v) Until such time the first Party elections are held, the first interim NEC members have the right to amend and ratify Rules, code of conduct and regulations of the Party, to make, amend and or revise the by laws, rules and regulations as required, for regulating of the affair of the Party and those governing its subsidiary organization and its operational parts. There after the NDC shall consider, modify and, if it thinks fit, ratify the constitution, Rules and regulations of the Party, and those governing its subsidiary organization and its operational parts.

(vi) To receive, examine and approve the annual report and audited accounts of the Party.

(vii) To appoint Auditors and fix their remunerations

(viii) To appoint other committees within the Party as and when seems necessary for specific tasks, and also stipulate and outline their terms of reference, and reporting procedures.

(ix) To receive regular reports from the National Governing Council and the National Executive Committee on the operations of the Party.

(x) To appoint an independent and competent Party’s Election Commission as stipulated in Articles 11 hereinafter.

(xi) To make, amend and or revise the by laws, rules and regulations as required, for regulating of the affair of the Party.

(xii) To appoint the Trustees of the Party as provided in Article 12, hereinafter

(xiii) To consider any such other items as may be referred to it by the National Executive Committee.

(xiv) Apart from the first interim Party leadership the NDC receives the Party Manifesto from the National Executive Committee for serenity, approval and/ amendments.

c) An ordinary Session of the National Delegates Convention shall be held at least once every two (2) years at a place and date to be determined by the National Executive Committee. The notice for the meeting shall be sent out by the Secretary General at least six weeks before such date. The agenda shall be communicated by the secretary-general to all delegates at least three weeks before the date of the meeting.

d) A special session of the National Delegates Convention shall be summoned by the Chairperson upon the decision of the National Executive Committee or upon a requisition in writing by at least one third of the delegates attending the proceeding National Delegates Convention.

ARTICLE 9: THE NATIONAL GOVERNING COUNCIL (NGC)

a) There shall be a National Governing Council which shall be the second highest organ of the Party.

b) The National Governing Council (NGC) shall consist of the following members:-

(i) All the National Official of the Party.

(ii) All members of the National Executive.

(iii) All members of the Party’s Parliamentary Group.

(iv) All members of the Board of Trustee and the Party Election Commission.

(v) All Chairpersons of the Branch Executive Committee.

c) The national Governing Council shall have the following functions:

(i) To review and / or formulate policies of the Party for approval by the National Delegates Convention.

(ii) To initiate all such activities as may further the aims and objectives of the Party.

(iii) To receive reports from the National Executive Committee on the operations of the Party and

(iv) To make policy and administrative decisions on behalf of the NDC which (in the opinion of the NEC) can not wait until the next NDC, and the present such decisions for ratification at the next NDC.

(v) To monitor the general activities of the Party on behalf of the National Delegates Convention and to provide direction for such activities.

d) The national Governing Council may establish specialized committee and other advisory bodies as are necessary to carry out aims and objectives of the Party and

e) The National Governing Council shall meet at least once every twelve months.

ARTICLE 10: THE NATIONAL EXECUTIVE COMMITTEE (NEC):-
a) There shall be a National Executive Committee (NEC) which shall consist of the following members:-

(i) All the National Officials of the Party.

(ii) The Chairperson, Secretary and chief whip of the Party’s Parliamentary Group if any

(iii) The Chairpersons of the Board of Trustee and the Party’s Election Commission.

(iv) Not more than five Party members nominated by the NEC to cater for special interests; and

(v) The Party’s executive Director, who shall be an ex-official member.

(vi) The director of Elections, who shall be an ex-official member

(b) The national Executive Committee shall have the following functions:-

(i) To act as the Executive body of the national Governing Council and the National; Delegates Convention, and to ensure that all decisions made by those bodies are duly carried out and all the policies are adhered to;

(ii) To supervise the administrative machinery of the Party at all levels and to take such measures as it seems necessary to enforce the decisions and programmes of the Party as laid down by the National Governing Council and the National Delegates Convention.

(iii) To work in liaison with and to oversee the work of the Party Congress of youth women and children

(iv) To approve the terms and conditions of services of the staff member employed by the Party.

(v) To appoint other committees as it seems necessary from time to time, for specified tasks and to determine their terms of reference.

(vi) To receive, consider, approve and implement reports and recommendations from the various standing, ad hoc and specialized committees or individuals; and where not empowered by this Constitution without prior approval of the National Delegates Convention and / or the National Governing Council (NGC) to forward the same appropriate authority for such approval.

(vii) To initiate, prepare or cause to be prepared the necessary quarterly semi-annual or annual financial budgets for approval by NGC and / or the NDC.

(viii) To liaise with the Party Election Commission in order to ensure co-ordination of elections of Party officials at all levels and Party nominations for Presidential, Parliamentary and Civic candidates.

(ix) To appoint various schemes aimed at stimulating, Party activities.

(x) To ensure that the agenda for, and reports to the National Delegates Convention or National Governing Council, are prepared and on time.

(xi) To recommend names for consideration for appointment as members of the Party Election Commission and Board of Trustees by the National Delegates Convention.

(xii) To make or cause to be made Rules and / or regulations for prescribing anything which requires to be prescribed under this constitution and generally for the better carrying out of the provisions of this constitution and matters incidental thereto; and

(xiii) The national Executive Committee may suspend or dismiss any office bearer for gross misconduct after the said officer has been given a fair and reasonable opportunity to present a defense against charges or allegations made against him or her. Such suspension or dismissal shall be subject to review or approval by the next National Delegates Convention and vacancies thus or otherwise created shall be filled in the same manner as they were originally filled.

(xiv) Appoint a Director of Elections

b) The National Executive Committee shall meet at least once a month.

c) A member of the NEC who absents himself/herself for three consecutive meetings without submitting a written apology, shall forfeit his/ her position. In such a case the NEC shall have power to nominate another member of the Party to substitute for him/her subject to approval by the subsequent NGC.

ARTICLA 11: PARTY ELECTIONS COMMISSION (PEC):-
a) The Party shall establish an Election Commission comprising of well-established respected and knowledgeable member of the Party.

b) The commission shall consist of ten members, the chairperson, vice chairperson, and eight members, one from each of the eight (8) province who shall be appointed by the NDC on recommendation by the NEC; shall hold office from a period of five years; and shall be eligible for re-appointment.

c) The National Organizing Secretary and National Secretary for legal and Constitution Affairs shall be members of PEC.

d) The Commissioner shall be persons who are:-

(i) Fully paid member of the Party.

(ii) Citizen of Kenya of the age of no less than eighteen years and

(iii) Not holder of any other office of the Party.

e) The commissioner shall make rules and procedures of nominations and elections and present them for ratification by the NDC.

f) The commissioner shall organize and supervise all the elections of the Party and Party nominations for, presidential, Parliamentary and civic candidates in liaison with the NEC and

g) The PEC shall met at least once in every six months and shall have a quorum of not less than four (4) members present and shall determine the procedures at its own meetings.

ARTICLE 12: THE BOARD OF TRUSTEES (BOT):-
a) There shall be nine (9) Trustees, a chairperson and eight (8) other Trustees one from each of the eight (8) Provinces of Kenya, to be appointed by the National Delegates Convention upon recommendation by the NEC.

b) Thee shall be a Trust Deed where all land, buildings and other movable property, investment and securities that may be acquired by the Party shall be vested in the names of the trustees.

c) The trustees shall be appointed for a period of five (5) years and shall be eligible for re-appointment. None of the trustees shall be removed from office except on any of the following grounds:

i. Voluntary resignation in writing addressed to the National Chairperson.

ii. Insanity

iii. Bankruptcy and

iv. If a motion calling for the removal of such a person is passed by a two thirds majority of the National Delegates Convention of member attending the convention at which the issue is raised.

d) The quorum necessary to transact business by the trustees shall be six (6) Trustees personally present.

e) The Trustees shall pay all income received from the property vested into Trustees to the Party treasurer. Any expenditure in respect of such property invested or securities which in their judgment is deemed as prudent shall be reported to the National Executive Committee which may authorize expenditure of such monies as it think fit and

f) The BOT is expected to raise funds and develop investment portfolios on behalf of the Party and in liaison with the NEC and BECs.

g) The BOT shall establish a secretariat, which will be headed by a programme Director and a DEPUTY. The said offices will be appointed by the BOT and their appointment ratified by the NEC.

h) The Board of Trustees shall meet at least twice a year and in the absence of the chairperson the Trustees present should elect one among them to preside.

ARTICLE 13: STANDING, AD HOC AND SPECIALIZED COMMITTEES (SASC):-

a) The National Delegates Convention, the National Governing Council and/ or the National Executive Committee may establish standing ad hoc and / or specialized committees as they may deems necessary.

b) These committees shall consist of competent people possessing relevant knowledge and skills in the areas in which that are called to serve.

c) Assignments for such committees shall include research, investigation and evaluation of specialized projects and their findings shall be reported to the Party organs which appointed them. Such report includes specific proposals and recommendation for implementation. Such committees may also be called upon to implement recommendations, conduct fund raising; and

d) The chairperson shall appoint, with approval of the NEC, National Secretaries based on the operative Ministries of the Government of Kenya and whose number shall be determined by the number of ministries. The Secretariat shall form standing Committees to serve the Party as committees for:-

i. Agriculture, lands, NATURAL Resources and Environment

ii. Education, Health, Rural and Social development.

iii. Power, communication, Transport and works

vi. Interior, Local Administration, Information an justice and

vii. Finance, Economic Planning, Trade and Industries.

This Committees shall investigate and inquire into the activities and administration of ministries or Departments assigned to them and such investigation and inquiry may extend to proposals for the Party Policy formulation and programme of action, and the Committees shall have power to co opt other members. The National Secretaries will on their part service their respective “Shadow Ministers” on a day to day basis, as well as the NEC. They shall be co-opted members of the NEC as and when necessary.

d) Whereas such committees are expected to serve on voluntary basis, the Party shall provide them with the necessary financial personnel and special facilities to enable them to function effectively.

ARTICLE 14: BRANCH ORGANIZATION PARTS (BOPs):-

a) There shall be Branch organization parts which shall consists of:

i. The Branch Executive Committee

ii. The sub-branch Steering Committee.

iii. The Location/ Ward Managing Committee and

b) At least one third of the posts of the officials of BPOs shall be held by women.

14.1 Branch Executive Committee (BEC):-

a) The Party shall have branches, which shall be formed, on the basis of the administrative districts.

b) Each branch shall have a Branch Executive Committee which shall consist of the following members:

i. The branch chairperson, Vice Chairperson, Secretary, Treasurer, Coordinator for women affairs.

ii. The branch chairperson, Secretary, Treasurer and secretary for each sub-branch within the Branch.

iii. The Party members of the National Assembly within the Branch and

iv. The Branch Executive Officer who shall be an ex-official member and shall be appointed by the BEC.

c) The branch office bearers shall be elected at the branch Annual General Meeting (AGM) by secret ballot or any other acceptable method, hold officer for five (5) years and shall be eligible for re-election. The annual General Meeting shall be convened by the BEC not later that 31st October of every year.

d) The Branch AGM consists of:

i. All office bearer of the Branch Executive Committee

ii. All office bearers of the sub Branch steering Committee the chairperson, secretary, Coordinator for women Affairs, Young NSP members, Managing Committees and the chairmen of Sub-location/ward working committees.

iii. All the Party members of the National Assembly within the Branch and

iv. All the Party Councilors of the local Authorities within the Branch.

e) There shall be a branch Secretariat, headed by the branch Executive Office whose main functions shall be to manage the Branch office, service of the Branch Executive Committee and to co-ordinate the activities of the Sub-branches and liaise with the national Secretariat on all Party matters pertaining to the branch.

f) Duties of the branch executive committee shall include:

(i) To carry out activities objectives, and to promote the policies and programme of the Party.

(ii) To promote political, civic and general education amongst the people of the Branch.

(iii) To recruit and review Party membership in the branch

(iv) To ensure strict discipline and adherence to Party Policies and programmes amongst individual Party members and officials at their branch and the BEC shall have powers to suspend and /or recommend to NEC dismissal of an errant official who is within its jurisdiction, after such official, has been given reasonable opportunity to defend himself/herself and provided that the action taken does not contradict any other provisions of this constitution.

(v) To engage in income generating activities in the district and to manage the financial affairs of the Party at the Branch and

(vi) To nominate Party representative to various bodies within the Branch where appropriate.

g) The BEC shall meet at least every four months.

14.2 SUB-Branch Steering Committee (SSC)

a) There shall be established Party Sub-Branches in all parts of Kenya which shall be formed on the basis of Parliamentary Constituencies.

b) Each Sub-Branch shall have a steering committee, consisting of the following members.

i) The Sub- Branch Chairperson, the Vice-Chairperson, the Secretary, Treasurer, the organizing Secretary, the coordinator for Women Affairs, the Coordinator for young NSP members.

ii) The Chairperson, Secretary, Treasurer and Secretary of each location/ward unit within the sub-branch.

iii) The Party members of the national assembly for the area and

iv) The Party Councilors within the Sub-branch.

v) The Sub-branch Assistant Executive Officer who shall be ex-official member and shall be appointed by the SSC.

c) The functions of the sub-branch steering Committee shall include their inter alia keeping of all sub – Branch records, making the necessary returns to the branch, organizing the Party affairs at the Sub-branch, recruitment of members, and building a strong grass root Party support.

d) The Sub-branch Assistant Executive Officer shall be the head of the sub-branch secretariat and the secretariat shall service the sub-branch steering committee.

e) The sub-branch official shall be elected by the secret ballot or any other acceptable method during the Annual General Meeting (AGM) which shall be held not later that 30th September every year. The AGM shall be attended by:

i) All Sub-Branch steering Committee Members.

ii) All office bearers of the location/ward Managing Committees

iii) The Chairperson, Secretary, Treasurer, coordinator for women affair and coordinator for young NSP members of the sub location/ward working Committees.

iv) The area Member of the National Assembly.

v) All Party Councilors of the local Authorities within the sub-branch.

f) The sub-branch steering Committee shall meet at least once every four months.

14.3. Location Managing Committee (LMC):-

a) Each Party Sub-Branch shall have location/ward unit, which shall be formed on the basis of the administrative local Authorities Wards/Location within the sub-branch and shall have the managing committee.

b) The managing Committee shall consist of the following members:-

i) Chairperson, vice chairperson. Secretary General, Assistant Treasure, the organizing Secretary, the coordinator for women Affairs, the coordinator for young NSP members, Assistant Coordinator for young NSP members.

ii) The Party Councilors of the Local Authority for the area and

iii) The Chairperson, Secretary, Treasurer and the Organizing Secretary of the

Sub Location/Ward units within the Location/Ward.

c) The Location/Ward Unit Organizing Secretary shall perform the functions similar to those performed by the Assistant Executive Officer at the Sub Branch Level.

d) The Location/Ward unit shall hold an Annual General Meeting consisting of the Unit managing Committee, its Party Councillors the Local authorities and all the officials of the Sub Location/Ward units working committees. The AGM shall be held not later 31st August each year. Officials of the Location/Ward Managing Committee shall be elected at the AGM by secret ballot or any other acceptable method to serve for a period of five (5) years and shall be eligible for re-election.

e) The functions of the Location/Ward Managing Committee shall include the following: -

i) To carry out organizational and publicity work amongst the people within the Location/Ward in order to mobilize the support of the general public for Party policies, plans programmes or actions or any particular stand which may be taken by the Party from time to time.

ii) To carry out educational work amongst the membership and the general public.

iii) To convey to the grass root membership at the sub location level, the decision, programmed and policies of the NDC,NGC and NEC and conversely to inform through the sub branch steering committee, BEC, the NEC NGC and NDC of the recommendations.

iv) To scrutinize and vet the names of the Party ticket and make appropriate recommendations.

v) To prepare a quarterly report for discussion by the Sub Branch Committee and

vi) To liaise and co-ordinate with the Sub Location/Ward Committee for purpose of ensuring that Party matter and discipline are properly handled and maintained at both the Sub Location/Ward level and the Location level.

f) The Managing Committee shall meet at least once every four months.

14.4 The Sub-Location/Ward working Committee (SWC): -

a) Each Party Ward/Location unit shall be divided into Sub Location/Ward units formed of the basis of administrative Sub-Location/Wards within the Location/Ward and shall be managed by a Sub-Location/Ward Working Committee:

b) The Sub-Location/Wards units shall have the following officials: the Chairperson, Vice Chairperson, the Secretary, the Treasurer, the Organizing Secretary, the Assistant Organizing Secretary, the Coordinator for Women Affairs, the Coordinator for Chama Cha Mwananchi members.

c) The Sub-Location/Wards units Working Committee shall be elected at the AGM, which shall be held not later than 31st July of every year, by secret ballot or any other acceptable method, hold office for a period of five (5) years and shall be eligible for re-election.

d) The Sub-Location/Ward unit AGM shall include all the registered members of the Party within the area.

e) The working committee shall meet at least once every four months and shall be responsible for membership recruitment, a collection of membership dues, and propagation of Party policies at the grass root and the management of all Party affairs at the grass root levels.

ARTICLE 15: AUDITORS: -

The Party shall appoint or re-appoint reputable auditors at the Annual National Delegates Convention. All the Party account records and shall produce and submit audited accounts made up to date, which shall not less than six weeks and not more than three months before the date of the Annual National delegates Convention.

ARTICLE 16: ORGANIZATION OF WOMEN, CHILDREN AND YOUTH CONGRESS: -

a) There shall be Women Congress and Congresses of Chama Cha Mwananchi members at every level of the Party hierarchy.

b) The Organization of the Congresses shall begin at the Sub Location/Ward Level. The Congresses shall be organized by the Coordinators for Chama Cha Mwananchi Democrats.

c) All Women members of the Party in the Sub Location/Ward unit shall form the Women Congress at the level and shall select a committee with one representative from each of the Women Groups in the Sub Location/Ward units. The Congresses of Chama Cha Mwananchi members shall be organized in a similar manner.

d) All the Sub Location/Ward Committee members of the Congress shall constitute the Location/Ward congresses. They shall elect their congresses Location/Ward committee; and their Coordinators who will represent them in the mainstream Party Organization. Such pattern shall apply to all the congress, their committee and Coordinators up to the National Level.

e) The main purpose of the congress shall be; to handle all issues that are particular to women or the young, to enhance and strengthen the position of the women and the youth in the Mainstream Party management and to deal with, and to address themselves to all matters that will enhance the cause of Women or Youth.

ARTICLE 17: PROCEDURES AT MEETINGS: -

a) A quorum for the National Delegates Convention, National Governing Council, National Executive Committee, Branch, Sub-Branch, Location/ward Managing units and Sub Location/Ward units meetings shall be two third of the Membership thereof.

b) At all meetings of the National delegates Conventions, the National Governing Council, National Executive Committee, the Chairperson or in case of his/her absence, the Vice Chairperson shall preside. In the absence of the Chairperson and the Vice Chairperson the SG shall preside and in his or her absence the members present shall elect one from among themselves to preside.

c) At all meetings of the Branch, the Sub Branch or Location/Ward units, the Chairperson or in case of absence, the Vice Chairperson shall preside, in the absence of the Chairperson and the Vice Chairperson the members present shall elect one from among themselves to preside.

d) Resolutions, unless otherwise stated in the Constitution shall be decided by simple majority and voting shall be by show of hands or any other acceptable method.

e) In the event of an equality of votes at any meeting the person presiding shall cast the deciding vote and

f) Only fully paid members may attend Party meetings and vote. Any other person(s) may attend only on invitation.

g) Any meeting which has been postponed once for lack of quorum shall be deemed to be properly constituted to conduct business at the second sitting only if the matter is of much importance to the general membership of the party or if the officials concerned fail to attend without apologies, provided that the procedures of calling such a meeting were followed.

ARTICLE 18: QUALIFICATION FOR AND TERMINATION OF CHAMA CHA MWANANCHI PARTY LEADERSHIP: -

a) A Party member may hold a maximum only two offices within the Party hierarchy at any given time and Party official shall be deemed to have resigned from his/her office upon submitting an application for another office within the same committee in which he/she is serving.

b) A member shall not be qualified to be elected to a Party Office or be sponsored by the Party to any Public office and Party Official or such Public Officer shall cease to hold office if:

(i) The official is convicted by a court of competent jurisdiction of an offence involving dishonesty, theft of misuse of public funds, corruption, breach of trust, the manufacture, and sale or trafficking of drugs, or other serious offences of a public nature and, sentenced to a term of imprisonment exceeding six months, having exhausted the procedures of appeal provided by the law.

(ii) Is or becomes a member or supports any other Political Party or grouping whose purpose and objects are, in the opinion of the NEC inconsistent with or likely to be in conflict with those of Chama Cha Mwananchi without prior authority from NEC

(iii) The official is or accepts an office of profit, in the Civil Service of the Republic of Kenya or other public office the discharge of whose duties would be in conflict with the discharge of his or her duties as a Party official, and

(iv) Violates any of the Code of Conduct tenets or the Oath of Allegiance provisions stipulated as at Appendices I and II

(v) The official is insane, bankrupt, or is, in the opinion of two thirds of NEC, found unfit to be a Party Official.

ARTICLE 19: FINANCE

(a) The source of funds of the Party shall include the following:_

(i) Membership dues

(ii) Grants, supervisors, contracts, donations and legacies accepted by the National Executive Committee, or other authorized Party Officials on behalf of the Party

(iii) Net income from publications and other sellable items offered for sale to the public and

(iv) Revenue from all forms of investments which the Party may undertake directly or indirectly.

(b) The Party, through he NEC may borrow funds from any source it deems appropriate for the purpose of promoting the Party’s aims and objects and carrying our Party programs.

(c) Officials of the Party, and bodies created by NEC or NDC may /shall not/ incur expenditure in excess of the funds put at their disposal without prior authority in writing from NEC;

(d) The financial year of the Party shall be the Calendar year;

(e) The Party shall establish rules and regulations to govern the collection, keeping and disbursement of finance; and

(f) The National Treasurer shall be the Party’s Accounting officer

ARTICLE 20: PRESS AND PUBLICATIONS:

(a) The Party may own and operate a printing press and/electronic media and may have an interest in shares in any existing printing press and /or electronic media.

(b) The Party may publish its own literature, periodicals, magazines, pamphlets, books for own use, sale and/ or use by the public.

ARTICLE 21: DISSOLUTION

(a) The Party cannot be dissolved but by majority member democraticaly resolve that it be amalgamated, merged, or form a coalition.

ARTICLE 22: INSPECTIONS OF ACCOUNTS AND REGISTER OF MEMBERS:

(a) The books of accounts and all documents relating thereto and the register of members of the Party shall be available for inspection at the registered office of the Party by any officer or members of the Party giving not less than seven days notice in writing.

ARTICLE 23: AMMENDMENT TO THE CONSTITUTION: -

(a) Apart from the exemption and liberty given to the first interim NEC officials to amend this current constitution until such a time that recruitment of members is considered adequate to call for National Party elections, no change may be made in this constitution except with the approval of the National Delegates Convention and by at least two thirds of the votes cast by the members attending in person.

ARTICLE 24: ARBITRATION: -

1) Any dispute concerning the interpretation of this constitution or any disputes involving members of the Party and its leadership or any dispute concerning any matters relating to Party affairs or the management of the Party shall be adjudicated upon through internal Party arbitration. The Parties concerned shall agree on three internal arbitrators. The decision of the Internal Arbitration shall be communicated to the NEC in writing which will make its recommendations and submit the same together with those made by the arbitrators, to the NGC, The NGC’s decision shall be final.

APPENDIX 1

CODE OF CONDUCT FOR LEADERS

All Party Leaders shall subscribe to the following code of conduct in their public affairs

(a) (a)All leaders in the Party Shall conduct themselves with the highest standard of personal integrity and honor and shall not involve themselves in dishonorable conduct which conduct includes without limitation the following:

(b) Corrupt application of public resources

(c) Discrimination on grounds of race, tribe, place of origin, sex or religion

(d) Practice of Nepotism, clanism, favoritism in management of public affairs

(e) Defrauding public revenue

(f) Incitement of people against the Party or against other Kenyans.

(b) All Party leaders shall subscribe to the belief in the equality of all persons irrespective of sex, race, tribe or religion and shall acknowledge that failure to do so shall constitute dishonorable conduct which will disentitle them from continuing to be leaders.

(c) In order to ensure a clean Party leadership as indicated in (a) and (b) above all Party leaders shall bind themselves by signing the Pledge of Commitment which appears as Appendix II

9. That I shall support free and fair elections within the Party and in Kenya.

10. That I shall oppose and never practice nepotism, clanism, sexism or tribalism and I shall ensure that the allocation of jobs and services is based on merit.

11. That I shall oppose and never practice corruption.

12. That I shall be transparent in all my business transactions and never allow my personal interest to prevail upon the public interest.

13. That I shall always defend and protect public property and expose any misuse of public property, assets and investments, irrespective of whoever is involved in the misuse.

APPENDIX III
CHAMA CHA MWANANCHI
NOMINATING PARTY CANDIDATES

a) Any paid up member shall have the right to offer himself to be nominated as a candidate for:

i) President in respect to Presidential Elections in which case the member shall be required to pay nomination fees in the amount of Kshs 10,000/= (Ten thousand) and present a nomination form in triplicate to the returning Office, duly signed by not less than one thousand paid up Party members.

ii) Members of Parliament in respect of Parliamentary Elections in which case the member the member shall be required to pay nomination fees in the amount of Kshs5,000/= (five thousands), and present a nomination form in triplicate to the Returning Officer, duly signed by not less than five hundred paid up Party members; and

iii) Councillor in respect of Civil Election in which case the member shall be required to pay nomination fees in the amount of Kshs.2,000/= (Two thousand) and present a nomination from in triplicate to the Returning Officer duly signed by not less than one hundred paid up Party Members.

b) Members of the Party shall cast their votes through secrets ballot or any other acceptable methods(s) for any of the candidates to be nominated for: -

i) President in respect to Presidential Elections

ii) Members of Parliament in respect of Parliamentary Election and

iii) Councillor in respect of Civic Elections.

c) Where only one person is nominated without opposition as a candidate for;

i) President in respect to Presidential Elections

ii) Members of Parliament Election and

iii) Councillor in respect of Civic Election, such person shall be declared the Party Candidate.

d) Party’s candidate shall be nominated in the manner prescribed in the Party’s Constitution: -

i) Presidential by the NDC,

ii) Parliamentary, by the Party Members within the Branch

iii) Civic, by the Location/Ward Party members within the Location/Ward

SECRETARY GENERAL CHAIRPERSON

ELECTIONS RULES

1) These rules may be cited as Election Rules and are made pursuant to the Constitution the CHAMA CHA MWANANCHI and are intended to apply to the elections and the governance of matter connected there within.

2) In these Rules unless the context otherwise provides or requires: -

“AGM” means the Annual General Meeting

“Constitution” means the Constitution of the Chama Cha Mwananchi

“Majority” means the greatest number of votes cast in any voting;

“Members” means a member of the Chama Cha Mwananchi.

“NDC” means the National Delegates Convention;

“NGC” means the National Governing Council;

“NEC” means the National Executive Committee;

“Party” means the Chama Cha Mwananchi;

“PEC” means the Party Election Commission.

PART 1

REGISTER OF MEMBERS

3) Every Sub Branch shall compile a Register of members which shall list group members by Sub Location/Ward in alphabetical order in Triplicates as in Form 1 in the Schedule to these Rules and shall show the membership number and the national identity card number. Such Registry shall be certified by the Chairperson, Secretary and Treasurer of the Sub Branch steering Committee.

4) The Sub Branch steering Committee shall retain a copy of the Register and submit the other copies to the National Secretariat.

5) a) The Sub Branch steering Committee shall ensure that a copy of the Sub Location/Ward/Register is available for members at the Sub Location Ward Level.

b) The said Register shall also be opened for Inspection at the Sub Branch Steering Committee Office by any member who desires to do so after giving seven days notice in writing and on payment of a fee of shillings twenty Kshs 20/=

6) Any person who considers that his/her name has been wrongly or unlawfully omitted from the said Register shall have the right to petition the Sub Branch Steering Committee. Any rectification of the said Register shall be communicated to the National Secretariat.

PART II

NOMINATION AND ELECTIONS

7) The NEC in consultations with the PEC shall appoint or declare a day for elections to be held;

a) At the Sub Location/Ward level at which all members will participate in electing the Sub Location/Ward Working Committee office bearers pursuant to Article 14.4 of the Constitution.

b) At the Sub Location/Ward level to elect committee members of the Women’s Congress and those of the Congress of National Star Party members pursuant to Article 16 of the Constitution;

c) At the Location/Ward level to elect office bearers of the Location/Ward Managing Committee pursuant to Article 14.3 of the Constitution.

Any member has a right to be nominated as a candidate for any office in the Sub Location/Ward Committee, Sub Branch Committee and in the Branch Committed as provided in Articles 14.4 of the Constitution.

9) Any member has a right to be nominated as a candidate for any of the National Offices specified in Article 6 of the Constitution and shall pay nomination fee of Kshs1,000/=.

10) An application form shall be presented by each candidate and shall contain the following details:

i) Name of Candidate

ii) Party Membership Number

iii) National identity Card Number;

iv) Postal and physical address;

v) Nomination fees receipt number;

vi) Names of proposer and seconder, who must be fully paid up members and

vii) Be accompanied by Curriculum Vitae in respect of the Sub Branch, Branch and National Offices and Pledge of Commitment duly executed.

11) The date and time of presentation of application forms/nomination papers shall be as follows:

a) in respect of Sub Location/Ward election the time shall be between the hours of six (6.00 am) and ten (10.00 am) on the date day of election;

b) in respect of Location/Ward election the time shall be between eight (8.00 am) and ten (10.00 am) day of elections;

c) in respect of Sub Branch/Branch elections, the period shall be not less than forty eight (48) hours before polling and

d) In respect of National Offices, the period shall be not less than two (2) weeks before the polling date.

12) The Party Election Commission shall appoint as Election Officials.

The Returning Officers, Presiding Officers and other Officers as: -

a) In respect of Sub Location/Ward election shall be: -

i) One Presiding Officer

ii) Two Clerks

b) In respect of Location/Ward elections shall be:-

i) One Presiding Officer

ii) Two Clerks

c) In respect of Sub Branch elections there shall be:-

i) One Returning Officer

ii) One Presiding officer, and

iii) Two Clerks;

d) In respect of Branch election there shall be: -

i) One Returning Officer

ii) One Presiding officer, and

iii) Two Clerks;

e) In respect of National elections there shall be: -

i) One Returning Officer and assistant and

ii) 20 Clerks

PART III

A. POLLING STATIONS

13) Each Sub-Location/Ward, Location/Ward, Sub Branch and the Branch shall have not less than one polling station, PEC shall, in consultation with the Sub-Branch and Branch Committee, appoint the place in the Sub-Location/ Ward, Location/Ward, Sub-Branch and Branch as the case may be established, and shall assign to each polling station a distinguishing mark and/or number and distribute the list to all Branches.

14) Each polling station shall be presided over by the Presiding officer.

15) The Presiding Officer shall, with the assistance of Chama Cha Mwananchi members regulate the number of electors/members to be admitted to the polling station at the same time and shall exclude all other persons except the candidates and their agents and/or persons necessarily assisting blind or incapacitated persons.

16) Each candidate may appoint in writing not more than two agents per polling station. Such appointment shall be notified to the Presiding Officer.

17) No person shall vote in a Sub-Location/Ward, Sub-Branch or Branch other than in respect of which he/she registered as specified in the Register compiled under rule 3 of these Rules.

18) The voting shall be by secret ballot or by any other acceptable method.

19) At the close of voting each polling station, the Presiding Officer shall in the presence of the candidate or their agents count the votes cast for each candidate and enter the results in Election Return Forms 2,3 and 4 in the Schedules to these Rules, which shall be certified by him/her and by candidates or by their agents. The Presiding Officer shall retain the copies of Election Return 2,3 and 4 and submit the originals therefore to the Returning Officer, after announcing the results of the elections.

APPEALS

20) Any application or candidate aggrieved by the decision of the Returning Officer or the Sub Branch Committee may appeal to the Director of Elections within 48 hours, and if the applicant is not satisfied with the latter’s decision, he/she (the appellant) shall appeal to the NEC within 24 hours. The decision of NEC shall be final.
